Perth Property Team – Bathroom Renovation Voucher $15,000 give-away Terms and Conditions

  1. This competition is a promotion run by NESL Pty Ltd ATF NESSL Unit Trust (“Promoter”). The Promoter is a licensed real estate agent.
  2. The Promoter, Reece Plumbing and Dale Alcock Homes are Promotion Sponsors.
  3. Entries and information on prizes and how to enter form part of these terms and conditions.
  4. Entries not completed in accordance with these Terms and Conditions are ineligible.
  5. Participation in this competition constitutes acceptance of these Terms and Conditions and all participants warrant that they have read, understood and agree to comply with and be bound by these terms and conditions.
  6. The competition is open to residents of Western Australia only and all entrants must be 18 years and over, own a property in WA (for which the voucher will be applied), one entry per person unless otherwise specified (i.e. there may be opportunities to submit additional entries offered during the course of the competition refer to conditions below).
  7. The competition will commence on 08.00am AWST Friday 20 December 2019 and conclude on 9am AWST on Wednesday 8th July 2020 (the “competition period”). With the draw taking place at 10.00am Friday 10th July 2020 inside 149b Jersey Street, Wembley by electronic random number generator.
  8. Employees and immediate family members of the Promoter or the Promotion Sponsors and associated persons and/or companies and related entities of the Promoter or the Promotion Sponsor are ineligible to enter.
  9. One winner will be selected at random from the correctly completed entries collected during the competition period.
  10. To qualify for the competition a person must submit their entry via the website address paultonich.com.au/competitions completing all required fields and agreeing to the terms and conditions of this competition the entry by 9am AWST Wednesday 8th July 2020.
  11. All entries become the property of the Promoter. No responsibility is accepted for late, lost or misdirected entries.
  12. The Promoter (subject to State and Territory Legislation) reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition.
  13. No entry fee is charged by the Promoter to enter the Promotion. Where entry is allowed online, there is no additional cost to enter the Promotion other than any cost paid by the Entrant to access the website or social media platform of entry via their internet service provider.
  14. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, power or technical failure, acts of God, civil unrest, strike, war, act of terrorism or any other cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.
  15. The prize consists of a bathroom voucher to the value of $15,000, which may only be redeemed in full through Dale Alcock Home Improvement. The voucher includes design, labour, selections and construction. All tile selections must be from Tiles Expo and all bathroom selections specified by Dale Alcock Home Improvement must be from Reece Plumbing ( price limits may apply to some selections). The bathroom renovation may exceed $15,000 in value but the additional cost must be paid by the winner. The prize is not redeemable for cash, if the renovation is less than $15,000 the difference will not be paid in cash and the winner forgoes the unused Value.
  16. The winner of the Voucher prize must own a property within metropolitan Perth (within 40km of Perth CBD)where the bathroom to be renovated using the voucher is located. The winner can not nominate a property that is not owned by the winner to be renovated. The winner must complete the renovation within 8 months of the competition draw date.
  17. Without limiting the foregoing, unless expressly stated in the terms and conditions all other expenses are the responsibility of the winner. Prizes are subject to the standard terms and conditions of individual prize suppliers. It is a condition of accepting any prize that the winner must comply with all the conditions of use of the prize.
  18. Prize components may alter at the discretion of the Promoter. Any change in the value of the prize between the publishing date and the date prizes are claimed is not the responsibility of the Promoter. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. Except as otherwise stated in these terms and conditions, the prize is not transferable, exchangeable or redeemable for cash.
  19. The Promoter reserves the right to request winners to sign a winner’s deed of release or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
  20. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including the identity, email address, age, place of residence of the entrant, proof of ownership of the property etc.) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  21. If there is a dispute as to the identity or validity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity or validity of the entrant.
  22. The winner will be publicly announced via Facebook on Friday 10th July 2020 on facebook.com/perthproperty.
  23. The winner will be notified by phone, email or mail. Competition results may also be published by both Dale Alcock’s and the Promoter’s media, including but not limited to Facebook and Instagram. Should an Entrant’s contact details change during the Promotion, it is the Entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
  24. The winner will be required to visit the offices of The Agency Wembley, 149b Jersey Street, Wembley on a date agreed upon, within 14 business days of the winner being announced (unless otherwise agreed), to be presented with the prize, sign documents, have photos taken, to be publicised across the Promoter’s, The Agency’s and any Promotion Sponsor’s media, including but not limited to Facebook and Instagram.
  25. The winner’s name will also be publicised by the Promotion Sponsors in their social media, website and other media and publications.
  26. If the winner is unreachable within 7 days of the announcement of the winner, the prize will be automatically forfeited, and another winner will be chosen.
  27. In the event of any prize not being accepted or claimed within 7 business days of initial contact or the winner being unable to be contacted, the relevant winner’s entry will be deemed invalid and the Promoter reserves the right to conduct a further draw on or before 30th July 2020.
  28. The Promoter and the Promotion Sponsors do not accept responsibility for any accident, loss, injury or damage to any individual or property arising out of or in connection with the competition or prize, either during or after the competition.
  29. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
  30. In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the competition, including but not limited to being interviewed and photographed. The winners (and their companions) agree to granting the promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winners (and their companions) will not be entitled to any fee for such use. Entrants must agree to make themselves available to any reasonable publicity requests made in relation to this competition without charge at a time specified by the Promoter, Dale Alcock and Reece Plumbing has the right to use such publicity photos, voice recordings, winners name in any medium and in any reasonable manner it sees fit.
  31. In participating in the prizes, the winner agrees to participate and co-operate as required in all editorial activities relating to the competition, including but not limited to being interviewed and photographed. The winner (and their companions) agree to granting the promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winners (and their companions) will not be entitled to any fee for such use.
  32. As part of the Promotion, the Promoter will collect Entrants’ personal information. If the Entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion. Submission of an entry is deemed to be consent by the Entrant to the Promoter collecting their personal information.
  33. The Promoter will use the personal information to enable an Entrant to participate in the Promotion.
  34. The Promoter may disclose Entrants’ personal information to third parties including its contractors and agents, prize suppliers, Promotion Sponsors and service providers to assist in conducting this Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation.
  35. The Promoter and Promotion Sponsors may use entrants’ personal information for future marketing purposes regarding its products, including contacting the entrant electronically. The privacy policies of the Promotion Sponsors are available on their respective websites. By entering their personal details the Entrant has given their consent to be contacted by the Promotion Sponsor.
  36. Personal information will be stored by the Promoter on a database controlled by the Promoter or by a third-party service provider of the Promoter or The Agency.
  37. Other than as stated, we will otherwise collect, hold, use and disclose your personal information in accordance with the Promoter’s Privacy Policy, which sets out how you may access and correct the personal information that we hold about you and how to lodge a complaint relating to our treatment of your personal information.  To view the Promoter’s Privacy Policy in full detail, go to paultonich.com.au . The Promoter of this competition will collect your name and contact details in order to include you in this promotion and may contact entrants for the purpose of this promotion.
  38. The Promoter may use the personal information provided to contact entrants with further offers including additional entries into the draw at the Promoter’s discretion during the competition period with additional entries related to the Promoter Dale Alcock, Reece Plumbing and associated services or employees.
  39. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  40. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.
    Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a prize.
  41. By entering this contest, you agree to a complete release of Facebook from any or all liability in connection with this contest. The Promoter acknowledges that the promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.
  42. Entry into this competition signifies acceptance of all conditions. The promoter’s decision will be final, and no correspondence will be entered into. The promoter reserves the right to limit entry or amend terms and conditions if considered necessary subject to State or Territory regulation.
